By Lantz Simpson The District has filed an application with the Chancellor's office in order to be exempt from complying with the 50% law for 1999-2000. Although the District reported to the state in September that the District was in fact in compliance for 1999-2000, the exemption was filed anyway. If the District is held to the Chancellor's ruling from this summer, then the District claims to be in compliance. However, if the District is held to the finding of the state auditor in October, then the District would not be in compliance. A public hearing before the Board of Trustees is set for December 11. The Trustees must vote to approve the exemption application before it is forwarded to the Chancellor. State law and regulations offer little guidance on how the hearing should be conducted, only that the Faculty Association has the right to be heard. The FA is now attempting to have the rules and procedures of the hearing clarified. Under state law and regulation, an exemption is to be granted only in cases of District hardship or payment of excessive salaries to faculty.
