FA Wins Grievance On Parking |

Hello Colleagues, As you may know On December 15, 2008, the Faculty Association filed a grievance when the District unilaterally reduced the number of unrestricted staff parking on the main campus. Despite several attempts by the Faculty Association to resolve this grievance, the grievance did not get resolved by the parties and therefore was submitted to arbitration. A hearing was held on September 2009. On January 29th, we received words from our legal counsel that the arbitrator has ruled in favor of the Faculty Association. The arbitrator writes: "Having carefully reviewed and weighed all the testimony and evidence presented at the hearing, and after considering each argument raised by the parties in their briefs, it is my conclusion that the District violated Article 18.4.1 by reducing staff parking spaces on the main campus below 536. Simply stated, Lot 6 is not part of the College’s “main campus” within the plain meaning of the Agreement." The arbitrator has asked the parties to meet and negotiate a remedy for this violation. Faculty Association and the District are scheduled to meet on February 23rd to discuss a remedy.
